These Terms govern your access to Brokist’s website, progressive web app and services. By creating an account or using Brokist, you agree to these Terms and the Privacy Policy.
1. Eligibility and accounts
You must be legally capable of entering a binding agreement and use Brokist for legitimate professional property-broker activities. Registration information must be accurate and current. You are responsible for your account, password, OTP and all activity performed through your account.
2. Platform role
Brokist provides technology for brokers to publish and discover property listings and buyer or tenant Needs, and to connect with other brokers. Brokist is not a party to property negotiations, brokerage arrangements, title verification, legal due diligence, financing, possession or completed transactions unless expressly stated otherwise.
3. User content and accuracy
You are responsible for listings, Needs, prices, descriptions, photographs, documents, contact details and messages you submit. You confirm that you have the authority and necessary permissions to publish them. Content must be accurate, lawful and not misleading, infringing, discriminatory, fraudulent or abusive.
You must independently verify ownership, title, approvals, RERA applicability, measurements, pricing, litigation status, identity and authority before acting on any opportunity.
4. Broker conduct
- Do not impersonate another person or create deceptive accounts.
- Do not upload confidential client data without lawful authority.
- Do not scrape, copy, resell or mass-export platform data.
- Do not spam, harass users, manipulate responses or bypass contact controls.
- Do not misuse contact details obtained through Brokist.
- Comply with applicable property, advertising, privacy, consumer and real-estate laws.
5. Memberships, credits and payments
Plans may include property, Need, contact and featured-listing credits, usage limits and validity periods. Credits are platform permissions, have no cash value and may expire with the applicable plan. Prices and benefits shown at purchase apply to that transaction. Payments may be processed by an external payment provider under its own terms.
Unless a specific refund policy displayed at purchase states otherwise, consumed credits and activated digital services are generally not refundable. Failed or duplicate payment claims will be reviewed using Brokist and payment-provider records.
6. Moderation
Brokist may review, approve, reject, suspend, remove or restrict content or accounts to enforce these Terms, protect users, comply with law or maintain platform quality. Approval does not constitute legal verification, endorsement or a guarantee of a property or broker.
7. Third-party services
Brokist may provide links or integrations for calls, WhatsApp, maps, OTPs and payments. Those services are controlled by third parties and their terms and privacy practices apply.
8. Availability and disclaimers
Brokist is provided on an “as available” basis. We do not guarantee uninterrupted availability, successful matches, deal completion, accuracy of user content or fitness of any property. Users must exercise professional judgment and obtain appropriate legal, financial and technical advice.
9. Limitation of liability
To the extent permitted by applicable law, Brokist will not be responsible for indirect or consequential losses, failed negotiations, user misrepresentation, title defects, third-party conduct or decisions made from platform content. Rights that cannot lawfully be excluded remain unaffected.
10. Suspension and termination
You may stop using Brokist at any time. Brokist may restrict or terminate access for breach, fraud, risk, prolonged inactivity or legal reasons. Provisions concerning content responsibility, payments, disputes and liability may survive termination where applicable.
11. Changes and governing law
We may update these Terms as the service changes. Continued use after an updated version becomes effective constitutes acceptance where permitted by law. These Terms are governed by the laws of India. The final legal entity and jurisdiction details should be inserted following legal review.
